Terms of Service

1. Definitions

In these terms of service, the following definitions apply:

  • - Nexifyhosting: the provider of hosting services.
  • - Customer: any natural or legal person who uses the services.
  • - Services: all hosting products offered by Nexifyhosting, including game servers, VPS servers, and demo servers.

2. Applicability

These terms apply to all agreements between Nexifyhosting and the Customer. By using our services, you agree to these terms.

3. Services & Availability

Nexifyhosting offers hosting services for Minecraft, FiveM, Discord Bots, and VPS servers. We aim for 99.9% uptime but do not guarantee uninterrupted availability. All servers are protected by DDoS mitigation from Servcity.

4. Demo Servers

Free demo servers are available for Minecraft, FiveM, and Discord Bots. Demo servers are limited to 1 GB RAM and 20 GB storage with a maximum duration of 2 hours. After expiration, the server is automatically suspended. The customer will receive an email notification. To reactivate the server, a paid plan must be purchased.

5. Payment

Payments are made via IBAN bank transfer or PayPal (Friends & Family). After receiving payment, the server will be activated within 24 hours. All prices include VAT unless otherwise stated. In case of late payment, the server may be suspended.

6. Prohibited Use

The Customer is expressly prohibited from:

  • - Using the services to carry out DDoS attacks or other cyber attacks.
  • - Using the services to distribute malware, spam, or illegal content.
  • - Publicly disclosing personal data of others (doxing). This applies to both customers and Discord members of Nexifyhosting.
  • - Using VPS servers to carry out network attacks.
  • - Using the services for activities that violate the law.

7. Doxing & Privacy Violations

Publicly disclosing or sharing personal data of other customers, Discord members, or employees of Nexifyhosting (doxing) is strictly prohibited. In case of violation, the server of the offending customer will be immediately suspended without warning. Nexifyhosting is not obligated to notify the customer or justify the suspension. There is no right to a refund in case of suspension due to doxing.

8. Suspension & Termination

Nexifyhosting reserves the right to suspend or terminate services in case of:

  • - Violation of these terms
  • - Non-payment of amounts due
  • - Expiration of demo periods
  • - Abuse of services

9. Liability

Nexifyhosting is not liable for direct or indirect damages resulting from the use of the services, unless there is intent or gross negligence. Total liability is limited to the amount paid by the customer to Nexifyhosting in the preceding 3 months.

10. Amendments

Nexifyhosting reserves the right to amend these terms. Changes will be communicated to customers by email. Continued use after amendment constitutes acceptance.

11. Applicable Law

These terms are governed by Dutch law. Disputes will be submitted to the competent court.
